Definitions

Harassment

Harassment is where one person engages in unwanted and unwarranted behaviour which has the purpose or effect of:

a. violating another person’s dignity, (every person has an innate right to be valued, respected and to be treated in a morally correct way) or;

b. creating an intimidating, hostile, degrading, humiliating or offensive environment related to, one or more of the following protected characteristics:

  • age

  • disability

  • gender reassignment

  • race

  • religion or belief

  • sex

  • sexual orientation

A person does not need to have clearly stated at the time that the behaviour was unwanted for it to be harassment.

Sexual Misconduct

Sexual Misconduct refers to a broad range of unwelcome behaviours of a sexual nature. As per our Bullying, Harasssment and Sexual Misconduct Policy, All Nations Christian College considers as sexual misconduct, sexual activity which is characterised by, but not limited to, any of the following behaviours:

  • Sexual harassment

  • Sexual violence, including within marriage,

  • Sexual assault,

  • Sexual abuse, whether physical, mental or emotional,

  • Grooming,

  • Coercion or bullying with sexual elements,

  • Sexual invitations and demands, including involvement in prostitution,

  • Sexual comments,

  • Sexual non-verbal communication,

  • Creation of atmospheres of sexual discomfort,

  • Promised resources or advancement in exchange for sexual favours,

  • Sexual activity without consent; consent is agreeing by choice, having the freedom and capacity to make that choice and to withdraw that choice at any time,

  • Viewing or distributing of pornographic materials.
